1. Designated Agent
Notifications of claimed copyright infringement should be directed to:
| Designated Agent | Hasan Orgun |
|---|---|
| Site | ELEPHANT NY |
| greentekno35@gmail.com | |
| Subject Line | "DMCA Notice" |
2. Required Elements of a DMCA Notice
A valid DMCA notice must include the following (per 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it (URL)
- Your contact information: name, address, telephone, email
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner
3. Counter-Notification
If you believe content was wrongly removed, you may submit a counter-notification including:
- Your physical or electronic signature
- Identification of the material removed and its prior location (URL)
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, phone, and consent to jurisdiction of the federal district court for your district (or, if outside the US, of any judicial district where we may be found), and to acceptance of service of process from the original notifier
4. Repeat Infringer Policy
In appropriate circumstances and at our sole discretion, we will terminate accounts or block submissions from users who are repeat infringers.
5. False Claims
Under § 512(f), any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be liable for damages. Submit notices in good faith only.
6. Outside the United States
Rights holders outside the US are welcome to use the same procedure; we treat all good-faith claims under equivalent care.
